The legal basis for this processing is to provide our service users, with their consent, the best support we can offer.
3.3 We may process information contained in any enquiry you submit to us regarding our services. The enquiry data may be processed [for the purposes of offering our services to you. - Procedure for necessary breach of confidentiality
4.1 All staff, service users, trustees or volunteers must raise the issue immediately with the Centre Manager, and explain why they feel confidentiality should be breached.
4.2 The Centre Manager must keep a written record of this discussion.
4.3 The Centre Manager is responsible for deciding if confidentiality should be breached.
4.4 The Centre Manager must contact the Chairman in the first instance, or Vice Chairman, and brief them and seek authorisation to breach confidentiality.
4.5 If a breach is authorised, a full written report must be made including action taken.
4.5 In no circumstances should any breach of confidentiality be discussed with the remaining board of trustees in order for them to be able to impartially undertake an investigation of a complaint at a later date.
- Retaining and deleting personal data
5.1 This Section 5 sets out our data retention policies and procedure, which are designed to help ensure that we comply with our legal obligations in relation to the retention and deletion of personal data.
5.2 Personal data that we process for any purpose or purposes shall not be kept for longer than is necessary for that purpose or those purposes.
5.3 We will retain your personal data as follows:
(a) Your personal data will be retained as long as you are an active service user. If you are no longer an active service user for a period of one year your personal data will be archived for a further period of five years following which your data will be disposed of by shredding or burning and digital data will be permanently deleted. If you become an active service user again before your data has been disposed of then we will retain your data as before. If you want to become an active service user again after your data has been disposed of then you will be treated the same as a new service user, but you will retain your original service user number.
5.4 Notwithstanding the other provisions of this Section 5, we may retain your personal data where such retention is necessary for compliance with a legal obligation to which we are subject, or in order to protect your vital interests or the vital interests of another natural person.
